Acceptance of Terms

Welcome to Destyn. By creating an account, accessing, or using the Destyn mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

These Terms constitute a legally binding agreement between you and Destyn. Please read them carefully.

Eligibility

To use Destyn, you must:

  • Be at least 18 years of age
  • Be legally able to enter into a binding contract
  • Not be prohibited from using the App under the laws of the United States, Canada, or your jurisdiction
  • Use the App only for personal, non-commercial purposes

By creating an account, you represent and warrant that you meet all eligibility requirements.

Account Registration

Authentication:

  • Destyn uses Sign in with Apple for authentication
  • You are responsible for maintaining the security of your Apple ID
  • You must provide accurate and complete information

Account Security:

  • You are responsible for all activity on your account
  • Notify us immediately if you suspect unauthorized access
  • Do not share your account credentials with anyone

One Account Per Person:

  • You may only create one account
  • Creating multiple accounts may result in suspension or termination

User Conduct

You agree to use Destyn responsibly and respectfully. You will NOT:

Prohibited Content:

  • Post nude, sexually explicit, or pornographic content
  • Share content depicting violence, hate speech, or harassment
  • Impersonate any person or entity
  • Post false or misleading information
  • Share spam, advertising, or promotional content
  • Infringe on intellectual property rights of others

Prohibited Behavior:

  • Harass, abuse, stalk, threaten, or intimidate other users
  • Use the App for commercial purposes or solicitation
  • Request money or financial information from other users
  • Engage in fraudulent, deceptive, or illegal activities
  • Attempt to access other users' accounts
  • Use bots, scripts, or automated tools
  • Scrape, copy, or harvest user data
  • Circumvent or interfere with security features

Respect Others:

  • Be respectful in all interactions
  • Respect others' boundaries and consent
  • Do not send unsolicited sexual messages or images
  • Accept rejection gracefully

Content Ownership and License

Your Content:

  • You retain ownership of all photos, messages, and content you post
  • By posting content, you grant Destyn a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content to provide and improve the App

User-Generated Content:

  • You are solely responsible for your content
  • Destyn does not endorse or guarantee the accuracy of user content
  • We reserve the right to remove content that violates these Terms

Prohibited Uses of Content:

  • Do not use other users' content without permission
  • Screenshots or recordings of private conversations are discouraged and may violate privacy laws

Privacy and Data Security

End-to-End Encryption:

  • All messages and shared photos are end-to-end encrypted
  • Destyn cannot read your message content
  • You are responsible for your encryption keys

Location Data:

  • Destyn uses your location to show nearby matches
  • You can disable location sharing in device settings
  • Distance to matches is approximate

Matching and Interactions

Discovery:

  • Matches are based on preferences, location, and availability
  • We do not guarantee any specific number of matches
  • Match quality depends on profile completeness and accuracy

Swipes and Super Likes:

  • Free users may have daily swipe limits
  • Super Likes may be limited (currently 5 per day)
  • Limits reset daily at midnight

Messaging:

  • You can only message users you have matched with
  • All messages must comply with our User Conduct policy
  • We may monitor unencrypted metadata (timestamps, sender/receiver) for safety purposes

Unmatching:

  • Either party can unmatch at any time
  • Unmatching removes the conversation for both users
  • Unmatched users will not appear in your discovery feed

Safety and Reporting

Your Safety:

  • Destyn is committed to user safety
  • We provide reporting and blocking tools
  • Use common sense when meeting people online

Meeting In Person: If you choose to meet a match in person:

  • Meet in a public place
  • Tell a friend or family member where you're going
  • Do not share financial or sensitive personal information
  • Trust your instincts

Reporting:

  • Report users who violate these Terms or make you feel unsafe
  • Available reasons: harassment, fake profile, spam, inappropriate content, underage user
  • We investigate all reports seriously

Automatic Blocking:

  • Reporting a user automatically blocks them from contacting you
  • Blocked users cannot see your profile or match with you

Premium Features and Payments

Subscription Plans: Destyn may offer premium subscription plans with additional features such as:

  • Unlimited swipes
  • Unlimited rewinds/undo swipes
  • See who liked you
  • Advanced filters
  • Boost (increased visibility)

Billing:

  • Subscriptions are billed through Apple's App Store
  • Prices are shown in the App Store and may vary by region
  • Subscriptions auto-renew unless cancelled before renewal date

Cancellation:

  • Cancel anytime in your Apple ID Subscriptions settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial periods

Refunds:

  • Refund requests must be made through Apple's App Store
  • Destyn does not control App Store refund policies

Free Trial:

  • Free trials, if offered, are available once per user
  • Subscription begins automatically after trial ends unless cancelled

Termination

By You:

  • You may delete your account at any time in Settings
  • Deleting your account removes your profile, matches, and messages

By Us: We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in illegal or harmful behavior
  • Create a fake or fraudulent profile
  • Are reported multiple times by other users
  • Are under 18 years of age

Effect of Termination:

  • You lose access to the App and your account
  • All matches and conversations are deleted
  • Subscriptions are not refunded upon termination for violations

Disclaimers

No Guarantees:

  • Destyn does not guarantee you will find a match or romantic partner
  • We do not conduct background checks on users (except photo/phone verification)
  • We are not responsible for user conduct or interactions

User Verification:

  • Verified badges indicate photo/phone verification only
  • Verification does not guarantee authenticity or safety
  • Users are responsible for their own safety

Service Availability:

  • The App is provided "as is" and "as available"
  • We do not guarantee uninterrupted or error-free service
  • We may modify, suspend, or discontinue features at any time

Third-Party Services:

  • Destyn integrates with Apple, Clerk, and Convex
  • We are not responsible for third-party service failures or policies

Limitation of Liability

To the fullest extent permitted by law:

  • Destyn is not liable for any indirect, incidental, consequential, or punitive damages
  • Destyn is not liable for user conduct, content, or interactions
  • Destyn's total liability shall not exceed the amount you paid for subscriptions in the past 12 months (or $100 if you have not paid anything)

This limitation applies even if Destyn has been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless Destyn and its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your use of the App
  • Your content or conduct
  • Your interactions with other users

Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of [Your State], United States, without regard to conflict of law principles.

Arbitration: Any disputes arising from these Terms or your use of Destyn shall be resolved through binding arbitration, except:

  • You may bring claims in small claims court if they qualify
  • We may seek injunctive relief in court for intellectual property violations

Class Action Waiver: You agree to resolve disputes individually. You waive the right to participate in class actions, class arbitrations, or representative actions.

Informal Resolution: Before initiating arbitration, contact us at legal@destyn.app to attempt informal resolution.

Intellectual Property

Destyn Ownership:

  • The Destyn App, logo, design, and content are owned by Destyn
  • You may not copy, modify, distribute, or create derivative works
  • "Destyn" and the "Destyn" logo are trademarks

License to Use:

  • We grant you a limited, non-exclusive, non-transferable license to use the App for personal purposes
  • This license is revocable at any time

DMCA: If you believe content on Destyn infringes your copyright, contact dmca@destyn.app with:

  • Description of the copyrighted work
  • Location of the infringing content (user profile, screenshot)
  • Your contact information
  • Statement of good faith belief
  • Statement under penalty of perjury that you are the copyright owner

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting an in-app notification
  • Sending a push notification
  • Updating the "Last Updated" date at the top

Your continued use of Destyn after changes constitutes acceptance of the new Terms. If you do not agree, you must stop using the App and delete your account.

General Provisions

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Destyn.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

No Waiver: Failure to enforce any provision does not waive our right to enforce it later.

Assignment: You may not assign these Terms. Destyn may assign these Terms in connection with a merger, acquisition, or sale.

Survival: Sections regarding disclaimers, liability, indemnification, and dispute resolution survive termination.
